Is this Copywriting infringment?

Okay, i was recently watching a movie that i really enjoyed (which is rare because im so picky) and it inspired me to right a screenplay for a short film (i have been making short films for years now, but never anything pro)…anyways, my question is… if i make a screen play which uses both the general idea of the movie its inspired from, and uses a few lines from the movie itself… is that against the law? i would also like to add, that i in no way intend to make profit on this short film, and i plan to just upload it onto youtube… i would also like to add that the short uses alot of my own ideas. and i planned to state in the credits that i was inspired my the movie.

It depends. What do you mean by general ideas? There have been a lot of movies about bank robberies. What do you mean by a few lines? There is no copyright on lines like I love you, I hate you, I don’t want to go there, it’s raining out….

I’d suggest you just go ahead and do it. Since you’re not making any money on it the worst thing that would happen is that the copyright owner would send you a letter asking you to remove it. At that point you can decide either to remove it or go to court and have a judge decide if it’s copyright infringement.
